Terms of service

1. Agreement

These terms are a contract between you and Creative Brackets AB, Hildedalsgatan 24, 417 05 Göteborg, Sweden, organisation number 559002-9624 (“Latensy”). By creating an account or using Latensy you accept them. If you use Latensy on behalf of an organization, you confirm you are authorized to bind it.

2. The service

Latensy is an uptime, performance, and incident monitoring service. It performs checks against services you configure, detects and records incidents, sends alerts to channels you connect, generates reports, and publishes status pages you choose to make public.

3. Accounts

  • You must provide a valid email address and keep your credentials confidential. You are responsible for activity under your account and for the team members you invite.
  • You must be at least 18 years old, or the age of majority where you live, to use Latensy.

4. Acceptable use

  • Only monitor services you own or are authorized to monitor. Do not use Latensy to probe, load-test, or interfere with third-party systems.
  • Do not use the heartbeat endpoint, public API, or badges in a way designed to circumvent rate limits or plan limits.
  • Do not publish unlawful, misleading, or infringing content on status pages.
  • Do not attempt to access other customers’ data or disrupt the service.

5. Plans, billing, and changes

  • Plan limits (monitors, check intervals, history, status pages, seats) are described on the pricing page and enforced in the app.
  • Paid plans are billed in advance, monthly or annually, through Stripe. Prices are in USD unless stated otherwise and exclude applicable taxes.
  • You may upgrade, downgrade, or cancel at any time. Downgrades and cancellations take effect at the end of the current billing period. History beyond the new plan’s retention period becomes inaccessible.
  • Paid plans include a 30-day money-back guarantee from first purchase. Contact support@latensy.io within 30 days for a full refund.
  • If a payment fails you will be notified and given time to update your payment method before features are restricted.
  • We may change prices with at least 30 days’ notice. Changes apply from your next billing period.

6. Availability and no guarantee

Latensy is a monitoring aid. We work to keep it available and accurate, but we do not guarantee that it will be uninterrupted, that every incident will be detected, or that every alert will be delivered. Monitoring results depend on networks and third parties outside our control. Latensy does not guarantee the uptime of your services.

7. Your data

You retain all rights to the data you configure and the results generated for you. You grant Latensy the right to process it to provide the service. Our handling of personal data is described in the privacy policy. You may export your check results at any time on plans that include export.

8. Intellectual property

Latensy, its software, design, and documentation are owned by Creative Brackets AB and its licensors. These terms do not grant you any rights to our trademarks or source code.

9. Limitation of liability

To the extent permitted by law, Latensy is not liable for indirect, incidental, special, or consequential damages, loss of revenue, or loss of data arising from use of or inability to use the service. Our total liability for any claim is limited to the amounts you paid for the service in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

10. Termination

You may delete your account at any time. We may suspend or terminate accounts that violate these terms or create risk for the service or other customers, with notice where practicable. On termination your data is deleted in accordance with the privacy policy.

11. Changes to these terms

We may update these terms. We will post the new version here and notify account holders of material changes by email. Continued use after the effective date constitutes acceptance.

12. Governing law

These terms are governed by the laws of Sweden, and disputes are subject to the courts of Göteborg (Gothenburg), Sweden, without prejudice to mandatory consumer protections in your country of residence.
